Terms and Conditions of Sale

Payment
Machines must be paid for in full, prior to delivery.
A minimum deposit of 50% (non-refundable) of the full purchase price with order and the balance on, or prior to delivery.
Works commence only when the deposit or full payment is received.
Any late payment, or problems with payment, Retro Arcade Machines LTD reserves the right to reclaim any costs involved in collection, or administering any outstanding payments.
The person who places the order for a machine, agrees to be personally liable for the payment for that machine.

Ownership and Title
Title shall not pass to the customer, until payments have been received in full, in cleared funds.

Cancellation
When a customer orders a machine ether verbally, in writing, or by making a payment, they agree to be bound by that order and cancellation of that order will only be allowed at the discretion of Retro Arcade Machines LTD. Should a customer wish to cancel an order a cancellation fee will apply.

Collection or Delivery
Customers who are collecting there machines, must do so within 10 days of notification that the machines are ready. After this time Retro Arcade Machines LTD shall be entitled to charge storage fees. All our machines are tested prior to delivery, if a customer arranges for their own delivery, Retro Arcade Machines LTD will not be held responsible for the machine arriving at the customers in working condition. Promises of delivery dates are made in good faith and are adhered to as closely as possible, but no responsibility is accepted for unforeseen circumstances arising delivery dates are based on production order runs and sometimes machines may arrive several weeks later than the prospected delivery date. Refunds will not be given purely because machines may arrive later than expected as they are bespoke made for each individual customer. We are a small company and any refund or partial refund is at the discretion of Retro Arcade Machines LTD

Warranties
All machines purchased from Retro Arcade Machines LTD will be covered by the following warranty :
Refurbished and Converted Machines - Back to base 3 months Parts and Labour – 12 months Labour only.
Brand New Machines - Back to base 12 months Parts and Labour.
Upgrades - Warranty and Onsite Service upgrades are available - prices vary per machine, please ask for details.
Any repair, service, or modification carried out on any machine by the customer, or any unauthorised third party during the warranty period, may invalidate the warranty.

Machine Hire
Once the customer has taken safe delivery of any machines owned, or operated by retroarcade.co.uk, they are responsible for the safe keeping of the machines and as such should ensure that they are added to the customers insurance for theft, or damage, at a value advised by Retro Arcade Machines LTD, for the duration of the hire period.

The Software
The emulation software operating on these machines is MAME FREEWARE, you are not being charged for this. The product sold comprises only of the hardware & the software menu system. At no point is MAME or any emulation software sold. IT is installed on the machine free of charge at the customers request. retroarcade.co.uk does not condone copyright theft.

General
If any part of these Terms & Conditions, are found to be invalid by any competent authority, then this shall not affect the rest of the Terms & Conditions, which shall stay in force.
The customer shall exercise due diligence in protecting the copyrights in the goods, so far as it lies in its power.
Retro Arcade Machines LTD does not accept any liability for damage to the machine as a result of misuse.
Any complaints should be made in writing to Retro Arcade Machines LTD, within 7 days of delivery.

Definitions
Back to base – Customer is responsible for the cost and organisation of the safe return and collection of the machine.
On site – Engineer will visit the machine on site at the earliest available date. Should the machine not be able to be repaired on site, the engineer will take the machine back to the workshop, affect the repair and return it to the customer at the earliest available date. On site engineer visits are chargeable unless covered by an extended warranty. All engineer visits will be by appointment, if the engineer cannot gain access at the agreed time, then a call out fee will be payable by the customer of £75.00.

Act of God
Retro Arcade Machines LTD shall not be held liable if it shall be unable to carry out any provision of the contract for any reason due to reasons beyond our control.

Law
These terms & conditions shall be governed by English Law and both parties agree to submit to the jurisdiction of the English courts.
